만일 공법관계라고 생각하고 행정소송을 제기했으나 법원이 사법관계로 보고 있다면, 아예 법원의 심판을 받아 보지도 못하고(각하판결), 다시 민사소송을 제기해야 하는 문제

공법과 사법을 분시하지 않으면 경찰이 범죄자를 다룰 때에도 수사를 허락받아야 하고 집안에 마음대로 들어가지도 못하고 공무원의 업무수행이 이루어지지 못함
